Phone was defective!!

This phone is not an awesome phone, when I received this phone the settings was all in Spanish language, and I tried to make a call the reception was horrible. This phone is my worst purchased ever from Amazon, today I went to the post office to return this defective devise upon looking at the back label the seller claims that he/she charges a restocking fee for example.{$20.00 for order value $1.00-$50.00}{$35.00 order value $50.00-$249.99}{$45.00 for order value $250.00-$499.99}{$55.00 for order value $500.00-$999.99}To my understanding I paid $39.99 for a phone that was defective and this seller claims that he/she will be taking $20.00 from my money that I worked very hard for, oh I had to pay to ship this phone back to the seller and I will only be refunded $19.99. well I will see if Amazon will allow kind of unethical business, again I just returned the phone to the seller today and I am waiting for a full refund.3/31/2013 This seller contacted me stating that I will not be charged a re-stocking fee, all I have to say is buyers bewared read the fine prints because they will try.

i love the color! i am really not used to using such a simple phone, but i like this one. i only use it for texting and calling, so its perfect.
